Habitect

Terms of Service

These terms are an agreement between you and Edumame Inc. (“we”) for your use of Habitect, on the web, in the Mac app and through its API. By creating an account or using Habitect you agree to them and to our Privacy Policy. If you do not agree, please do not use Habitect.

Your account

You must be at least 13 (or the minimum age in your country) to use Habitect. Habitect is invite-only for now. Keep your password and API tokens to yourself: you are responsible for what is done with your account, including by agents you give a token to. Tell us at admin@habitect.ai if you think someone else is using it.

Your content

What you write and upload stays yours. You give us permission to store, copy, process and show it only as needed to run Habitect for you: to sync it, to send it to the AI features you use, and to show pages you publish to the people who visit them. That permission ends when you delete the content, except for copies in backups until they are overwritten and pages others have already saved.

You are responsible for your content and must have the right to put it in Habitect. When you publish a page, anyone with the link can read it.

Acceptable use

Do not use Habitect to:

AI features and agents

Habitect can send your notes to AI models and to agents you connect. Their output can be wrong, incomplete or out of date: check it before relying on it, especially for medical, legal, financial or safety decisions. Agents act with the permissions you give them, on your computer and in your accounts, and you are responsible for what you let them do. Third-party tools you use with Habitect have their own terms.

Session recordings during the beta

While Habitect is in closed beta, your use of the app is recorded whenever you are signed in: the pages you open, what you click and the screen as you see it inside Habitect, notes included, so we can see how the app is used and fix what gets in the way. Recordings cover only Habitect, never the rest of your screen or other apps. Passwords, email addresses, sign-in codes, API tokens and anything the app marks secret or private are hidden. People who run Habitect can watch these recordings, live and afterwards. By using the beta you agree to this; you can turn recordings off in Settings → Privacy, and our Privacy Policy says how they are kept and deleted.

Plans and limits

Accounts have monthly limits on AI generations, agent tasks and recording. Habitect does not take payment yet; if paid plans come, their prices and terms will be shown before you agree to them. If you bring your own OpenAI key, OpenAI bills you for its use.

The service

Habitect is new and changes often. We may add, change or remove features, and the service may be unavailable at times. Keep your own copy of anything important: you can read all your notes through the API at any time.

Ending your use

You can stop using Habitect at any time and ask us to delete your account at admin@habitect.ai. We may suspend or close an account that breaks these terms or puts the service or others at risk, and will tell you why unless the law or safety prevents it. Sections that by their nature should last (your content, disclaimers, liability and the law that applies) continue after your account ends.

Disclaimers

Habitect is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability and non-infringement, to the extent the law allows.

Limitation of liability

To the extent the law allows, Edumame Inc. is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of Habitect. Our total liability for any claim about Habitect is limited to the greater of what you paid us in the 12 months before the claim and 100 US dollars. Some places do not allow these limits, so they may not all apply to you.

Indemnity

If someone makes a claim against us because of your content or your breach of these terms, you agree to cover the reasonable costs of that claim, to the extent the law allows.

Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules, and disputes go to the courts there, unless the law where you live gives you the right to bring them at home.

Changes

We may update these terms. We will change the date above, and tell you in the app or by email before a significant change takes effect. Using Habitect after that means you accept the new terms.
